Terms and Conditions of Use

1. Service Description

The Platform allows companies to:

• Input custom queries for interviews or surveys.
• Generate conversational links powered by artificial intelligence.
• Collect and summarize responses in a structured, filterable format.

Conversations are generated and processed using Google’s Gemini large language model and presented through our web-based interface. The service is accessible globally and hosted in the cloud with region-specific data compliance.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use the Platform. If you are accessing the Platform on behalf of a business, you confirm that you are authorized to accept these Terms on its behalf.

3. Account Registration

You may be required to create an account to use certain features of the Platform. You are responsible for:

• Providing accurate, complete registration information.
• Maintaining the confidentiality of your login credentials.
• All activities that occur under your account.

4. Use Restrictions

You agree not to:

• Use the Platform for unlawful or harmful purposes.
• Reverse-engineer, decompile, or tamper with the Platform.
• Input or transmit malicious code.
• Use the Platform to violate the rights of third parties, including privacy and intellectual property rights.

5. Data Privacy & Compliance

We are committed to protecting your data and the data of your respondents. All data is stored and processed in accordance with applicable data protection laws including, but not limited to, the GDPR (EU), CCPA (USA), and other relevant regional regulations.

• You are solely responsible for obtaining any required consents from respondents.
• By using our service, you confirm you have legal grounds for collecting and processing such data.
• You are solely responsible for ensuring that your use of the Platform complies with applicable laws, including obtaining all necessary notices, consents, and authorizations from survey respondents or interviewees.

Data processing is conducted via Google Cloud and Google's Gemini LLM in accordance with their data handling and compliance protocols.

6. Intellectual Property

All intellectual property rights in the Platform, including but not limited to software, designs, algorithms, and content generated by the system, are owned by InterBeYou Inc. or its licensors. Users retain ownership of their uploaded data and custom content but grant us a limited license to use it as necessary to provide the service.

7. Availability and Support

We aim to provide uninterrupted service, but we do not guarantee 100% uptime. Scheduled maintenance or unforeseen disruptions may occur. We offer technical support via hello@interbeyou.com.

8. Fees and Payment

Use of the Platform may be subject to subscription fees as outlined in our pricing plan. Fees are:

• Payable in advance unless otherwise agreed.
• Non-refundable, except as required by law.

Failure to pay may result in suspension or termination of access.

9. Third-Party Services

The Platform integrates with Google Cloud and Google's Gemini LLM. Use of these third-party services is governed by their respective terms and privacy policies. We are not responsible for their availability or functionality.

10. Confidentiality

Both parties agree to keep all confidential information obtained during the term of the agreement strictly confidential, including but not limited to business data, proprietary processes, and survey results.

11. Disclaimers

• The Platform is provided “as is” without warranty of any kind.
• We do not guarantee accuracy or fitness for a particular purpose.
• AI-generated responses should be reviewed for quality and relevance before reliance.
• You acknowledge that responses and summaries generated by AI models, including Google’s Gemini LLM, are machine-generated and may contain errors, omissions, or biases. You are solely responsible for reviewing and verifying any content before use.

12. Limitation of Liability

We work with care and skill to provide our Services and keep them safe, secure, and reliable. If we do so, we aren’t responsible for losses we didn’t cause, losses that couldn’t reasonably be predicted when we agreed to these Terms, or events beyond our control.

To the maximum extent permitted by law:

• We shall not be liable for indirect, incidental, or consequential damages.
• Our total liability for any claim arising from your use of the Platform shall not exceed the amount you paid in the past 12 months.

13. Termination

We may suspend or terminate your access to the Platform at any time for violation of these Terms or misuse.

We may suspend or permanently remove your account if it is not confirmed after registration, or remains inactive for a prolonged period, or if we suspect unauthorized use and cannot verify that you are the rightful account owner.

You may cancel your account at any time; however, subscription fees are non-refundable.

14. Updating Our Terms

We regularly update our services and features to improve our Platform and maintain a safe, lawful, and secure environment. This may require changes to these Terms, which will only be made when necessary and in a way that reasonably considers your interests or complies with legal or safety requirements.

Updated Terms will be posted on the Platform. Continued use of our Platform after the effective date means you accept the updated Terms. If you do not agree, you may close your account and must stop using our Platform.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA. Any disputes shall be resolved through good-faith negotiations, and if unresolved, submitted to the competent courts of Delaware, USA.
